Social Security Disability Benefits & Substantial Gainful Activity
In addition to providing enough medical evidence to the Social Security Administration (SSA) to prove that your condition is preventing you from working, you also have to meet the eligibility requirements involving substantial gainful activity.
Substantial gainful activity (SGA) is the amount of monthly income that an applicant cannot surpass in order to collect Social Security disability benefits. This amount generally changes each year to reflect the most recent national average wage index. If you make more money than the SGA limit, you will not qualify for Social Security disability benefits, even if you suffer from a qualifying condition.
For 2010, the substantial gainful activity limit for non-blind individuals is $1,000 per month. For blind applicants, the substantial gainful activity limit is $1,640. As of now, these numbers are expected to stay the same in 2011. This basically means that if you are not blind and currently bring home more than $1,000 a month in income, you will not meet the eligibility requirements for Social Security disability benefits.
It is important to note however, that the SSA's substantial gainful activity threshold for the blind does not apply to their Supplemental Security Income (SSI). The SGA does, however, apply to non-blind applicants applying for Social Security disability benefits or SSI.
Working with an Indianapolis Disability Lawyer
Meeting Social Security's definition of disability is just the first step in applying for Social Security disability benefits. The truth is, applying for these benefits can be extremely complicated as they require an extensive amount of paperwork and supporting medical evidence, including a thorough personal history (medical, employment, etc.).
Taking on these types of claims without legal help is not recommended, especially since if you need to file a Social Security disability claim you are already struggling with a serious condition or injury. Working with an experienced Indianapolis disability lawyer can help you determine eligibility and ensure your paperwork is submitted complete and on time.
